AMN SOLUTIONS END USER LICENSE AGREEMENT (EULA)
IMPORTANT-READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement
between you (either an individual person or a single legal entity) and the Licensor for
the AMN Solution software technology that displays this EULA, which includes any
associated media and Internet-related services (the "SOFTWARE").
OWNERSHIP
All right, titles and interest in and to the SOFTWARE and the files associated therewith
are owned by AMN Solutions. The foregoing rights to the SOFTWARE are limitedly licensed
to you as outlined herein. Nevertheless, this provision should not be construed as an
expression to assign or sell any copyrights or any other intellectual property rights to
the SOFTWARE from AMN Solutions to you
LICENSE
AMN Solutions grants you a license to use and copy the SOFTWARE program(s) and documentation
subject to the limitations described here. The license for a Trial Version expires 30 days
after it has been installed. The license for a Fully Licensed Version does not expire.
ADDITIONAL SOFTWARE/SERVICES
This EULA applies to updates, supplements, add-on components, or Internet-based services
components, of the SOFTWARE that AMN Solutions may provide to you or make available to you
after the date you obtain your initial copy of the SOFTWARE, unless they are accompanied by
separate terms.
BACKUP COPIES
You may make a reasonable number of backup copies.
DISTRIBUTION OF SOFTWARE
Any and all distribution of the Fully-Licensed Version is prohibited. Not-for-profit distribution of Trial Version is permissible, on condition that the software is not altered in any way and is distributed in its entirety. Electronic transfer, renting, leasing, loaning, selling or distributing of the Trial Version for profit in any form, including but not limited to bulletin board distribution, magnetic or optical medium distribution is not permitted without the written consent of AMN Solutions. Furthermore, modification, or alteration of the Software including but not limited to decompiling, disassembling, reverse engineering or creation of works arising from the Software is prohibited.
INSTALLATION
You may install the SOFTWARE on multiple computer systems, subject to the condition that you do not use the SOFTWARE on more than one computer hardware concurrently. For example, you may install the SOFTWARE on an office system and a home system.
CONSENT TO USE OF DATA
You agree that AMN Solutions and its affiliates may collect and use technical information gathered as part of the product support services provided to you, if any, related to the SOFTWARE. AMN Solutions may use this information solely to improve our products or to provide customized services or technologies to you and will not disclose this information in a form that personally identifies you.
COPYRIGHT
The SOFTWARE and ancillary material are copyrighted by AMN Solutions. Do not delete the copyright notice, trademarks or protective notice from your copy or any copy you make.
WARRANTY
AMN SOLUTIONS DOES NOT WARRANT THAT THE SOFTWARE WILL BE FREE FROM ERRORS OR WILL MEET YOUR SPECIFIC REQUIREMENTS. THE SOFTWARE IS MADE AVAILABLE TO YOU "AS IS." HOWEVER, IF A PROBLEM IS DISCOVERED AND REPORTED, AMN SOLUTIONS WILL TAKE REASONABLE MEASURES TO CORRECT THE PROBLEM.
LIMITATIONS AND LIABILITY
AMN SOLUTIONS MAKES NO WARRANTY OR CONDITION, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, REGARDING THE SOFTWARE. IN NO EVENT SHALL AMN SOLUTIONS OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OF USE OR DATA, OR INTERRUPTION OF BUSINESS, WHETHER THE ALLEGED DAMAGES ARE LABELED IN TORT, CONTRACT OR INDEMNITY.
